KUALA LUMPUR: Umno president Najib Razak was chosen by Allah to lead the party and, hence, the party members should pledge their loyalty to him, said Ahmad Zahid Hamidi.
The Umno acting deputy president, setting an example in the presence of the party delegates at its general assembly this evening, pledged his undivided loyalty to Najib.
“Allah has put Datuk Seri Najib as our president. Allah wanted it that way,” he said at the Putra World Trade Centre here.
“So I call upon all members to pledge your loyalty, not just through your voices but also through your actions, as taught by our religion.
“To ensure Umno stays strong forever, all members should be loyal, regardless of the criticisms or rumours made against the party president.
“My loyalty to him will not cease.”
Zahid, who is also the deputy prime minister, then urged Umno cybertroopers to play their part and fight against the opposition’s attempts to attack Najib and the party online.
“We can’t see them but we can feel the presence of these opposition groups in cyberspace.
“Our cybertroopers need to form strategies and go against the enemies, not one another. And we have to bring the people, especially the Gen-Y and Gen-Z, closer to us.”
He added that technological advancements have made it harder for Umno to identify both their internal and external enemies.
“We are not only facing the traditional political parties but also groups that are against us in secret, hiding their true colours.
“Without us realising it, the enemy among us operates through the cyber platform and gadgets.”

The Conspiracy to Save Najib
In an extraordinary twist, a new Malaysian website has conflated George Soros, Tony Blair, former US Vice President Al Gore, the “Clinton team,” the aristocratic Rothschild family,  Federal Bureau of Investigation deputy chief Andrew McCabe, former golfing buddy and US President Barack Obama, UK critic Clare Rewcastle Brown and her husband, unnamed individuals from the Goldman Sachs and JP Morgan investment banks, and a flock of locals into elements of a conspiracy “to restructure the East Asian economy and political landscape,” but particularly arrayed against Malaysia and its prime minister Najib Razak.
The website, “Malaysia Outlook,” written by the pseudonymous “Third Force,” has printed four exhaustive articles detailing the conspiracy, “a nexus of associations linking key individuals, establishments, institutions and agencies, complicit with global elites to effect regime changes in Malaysia and Indonesia.”
In fact, however, the website appears to be the latest attempt to protect Najib from public scrutiny of overwhelming international evidence of his complicity in the biggest scandal in Malaysian history, the theft of at least US$2.5 billion and perhaps as much as US$4 billion from 1Malaysia Development Bhd., the state-backed investment firm that was so disastrously overseen that it is believed to have lost as much as RM50 billion (US$11.316 billion) through theft and mismanagement. An unknown amount of that money allegedly went to finance Red Granite Pictures, the Hollywood entity that produced the blockbuster movie “Wolf of Wall Street. “
The lead investigation is in the hands of the US Justice Department, which in July issued a 136-page document alleging that “over the course of an approximately four year period, between approximately 2009 and at least 2013, multiple individuals, including public officials and their associates, conspired to fraudulently divert billions of dollars from 1MDB through various means, including by defrauding foreign banks and by sending foreign wire communications in furtherance of the scheme, and thereafter, to launder the proceeds of that criminal conduct, including and through U.S financial institutions.
“The funds diverted from 1MDB were used for the personal benefit of the co-conspirators and their relatives and associates, including to purchase luxury real estate in the United States, pay gambling expenses in Las Vegas casinos, acquire more than US$100 million in artwork, invest in a major New York development project, and fund the production of major Hollywood films. 1MDB maintained no interest in these assets and saw no returns on these investments.”
For months, Najib and his cronies in the United Malays National Organization, the country’s biggest political party, have been attempting to wriggle free from domestic and international charges over the theft of the money.  According to multiple sources in Kuala Lumpur, he has survived as prime minister primarily by bribing the 190-odd cadres who determine the leadership of UMNO to keep him in power. UMNO leadership confers automatic status as prime minister.
Against devastating articles in the Wall Street Journal, the New York Times, the Sarawak Report, Asia Sentinel and other publications, Najib, who is alleged to have diverted at least US$681 million and perhaps as much as US$1 billion into his own accounts, is believed to have mounted a flurry of online fake new outlets, the best-funded of which appears to be Malaysia Outlook.
Malaysia Outlook is said to be the brainchild of Habibur Rahman Kadir Shah, an accountant and a long-time associate of Najib Razak.  Habibur was previously an UMNO Youth head in the Kuala Lumpur suburb of Petaling Jaya when Najib was national youth head.  The two became close friends.
“Najib has given control of running the media hounds to Habibur, who has been at it since Najib became Prime Minister,” said a well-connected political source in Kuala Lumpur. Habibur, in addition to serving as the informal media dictator to the Star, the New Straits Times Press and TV3 – the three most prominent English-language media outlets – is reportedly the controller and paymaster, with Najib’s money, for the bloggers who write for Malaysia Outlook, including Raja Petra Kamarudin, who formerly was a major opposition blogger but who has since joined Najib’s crew.
The key members of the team are said to be Raja Petra Kamarudin, universally known as RPK, as well as Rahmat Haniff, the son of a former Inspector General of Police Haniff Omar , who calls himself seademon, and Zakir Mohamad,* who writes a blog called bigdogdotcom.  They are said to be paid well to produce what appears to be the very definition of fake news.
In recent weeks, the Malaysian government has raised the ante against opposition figures, briefly jailing Maria Chin Abdullah, the head of the electoral reform organization Bersih 2.0 (“clean”) and attacking the editor and publisher of Malaysiakini, the country’s most popular independent news website, on allegations they are in the pay of Soros, who is accused of attempting to destabilize the country.
But a close look at the US Justice Department document paints a picture not of an international conspiracy against Malaysia but of a breathtaking campaign to divert billions of dollars out of 1MDB and into the hands of the prime minister, known in the document as “Malaysian Official 1” and his family, beginning in 2009 with the diversion of funds into a corporate entity called “Good Star” under the pretense of investing in a middle-eastern oil exploration company called Petro Saudi.
As much as US$1 billon was allegedly diverted into Swiss bank account held by Good Star Ltd., whose beneficial owner was Jho Taek Low, better known as Jho Low, the youthful, rotund Penang-born financial whiz who convinced Najib to set up 1MDB in the first place.
As has been widely reported, billions more were diverted through an entity called Aabar-BVI, which “was created and named to give the impression that it was associated with Aabar Investments PJS,” a legitimate subsidiary of the International Petroleum Investment Company, a state-owned Abu Dhabi investment concern.
And where did the money go? It poured into a stunning assortment of US real estate and other properties. That includes, but was not limited to:
THE L’ERMITAGE PROPERTY, 9291 Burton Way, Beverly Hills, California 90210 – better known as L’Ermitage Hotel.
HILLCREST PROPERTY 1, a mansion  at 912 North Hillcrest Road Beverly Hills, owned by a shell company.
PARK LAUREL CONDOMINIUM, real property located in New York, New York owned by Park Laurel Acquisition LLC, a shell company
BOMBARDIER JET: Global 5000 aircraft bearing manufacturer serial number 9265, registration number N689WM.
TIME WARNER PENTHOUSE:  located in New York, New York owned by 80 Columbus Circle (NYC) LLC, a shell company.
ORIOLE MANSION:  real property located in Los Angeles, California, owned by Oriole Drive (LA) LLC, a shell company.
GREENE CONDOMINIUM:  real property located in New York, New York owned by the 118 Greene Street, a shell company.
EMI ASSETS:  including copyright and intellectual property rights, as well as the right to collect and receive any profits, royalties, and proceeds of distribution owned by or owed to JW Nile (BVI), Ltd.; JCL Media, a shell company.
SYMPHONY CP (PARK LANE) LLC ASSETS:  a Delaware limited liability company, owned, held or acquired, directly or indirectly, by Symphony CP Investments LLC and Symphony CP Investments Holdings LLC, shell companies that own the Park Lane Hotel at 36 Central Park South, New York, New York, 10019.
WALKER TOWER PENTHOUSE:  located in New York, New York owned by 212 West 18th Street LLC, a shell company,
LAUREL BEVERLY HILLS MANSION:  located in Beverly Hills, California, owned by Laurel Beverly Hills Holdings, LLC, a shell company.
HILLCREST PROPERTY 2: located in Beverly Hills, California owned by 1169 Hillcrest Road LLC, a shell company.
THE QENTAS TOWNHOUSE:  located in London, United Kingdom, owned by Qentas Holdings Ltd., a shell company.
Those transactions are reported in exhaustive detail in the US Justice Department’s filing, which is worth reading for its entertainment value if not its educational value for the citizens of Malaysia. If it is fiction constructed to destabilize the country and bring down Najib, it is a far more sophisticated job than The Malaysia Outlook. Then again, the chances are better that it is real.

As news has emerged of the Royal pardon granted by Thailand to the Swiss national Xavier Justo, his wife has received two serious warnings from high level sources that Malaysian related entities have been instructed not to let him leave the country alive.

Sarawak Report has confirmed that the two entirely separate sources have tonight indicated that there is a ‘Black Ops’ notice out to ensure that an ‘accident’ befalls Justo during his vulnerable journey from the jail, where he has been securely protected, first to emigration and then the airport. He is due to be released in the coming days.

“The instructions come from Malaysia”

The instructions are from Malaysia” one key source which has high level security links has warned Sarawak Report.  “They plan to use local operatives with connections to official bodies to make sure he will not make it out of Bangkok”.

Another separate source also approached Sarawak Report this evening “Either an accident or a hit man, there are Malaysian related entities with far-reaching contacts in Thailand and there is evidence that the instruction has gone out”.

The news has thrown Swiss based Laura Justo, who has been waiting in Geneva anxiously for her husband for several months, into a new state of anxiety.

This evening she told Sarawak Report that she has notified her lawyers, The Swiss Embassy and several international law enforcement bodies about the level of the threat, but she is fearful that they may fail to provide adequate protection for her husband once he leaves the jail.

“The Swiss officials are already been aware of the possible threat” Laura told Sarawak Report this evening, ” but I do not know if they will do enough to protect him. It depends on the size of the planned operation to kill him”

Laura says she is also fearful of an attempt to kidnap Justo.
The Malaysian authorities have made no secret of their determination to lay hands on the key whistleblower, who was imprisoned June 2015 for revealing details of the PetroSaudi deal, which has led to the unravelling of the world’s biggest ever kleptocracy case related to Malaysia’s development fund, 1MDB.

Justo had originally been promised his release back in August, not long after the US Department of Justice lodged its asset seizure notice for a billion dollars worth of property with the California District Court.  Just yesterday a US Federal Court Judge rejected an attempt by Jho Low (the prime minister’s key advisor on 1MDB) to stay that seizure on assets held in the name of himself and his family.

However, just days before the papers were due to be signed Malaysian Prime Minister Najib Razak made an extended visit to Bangkok and placed Justo at the top of the agenda for talks.

The Prime Minister made plain that he wanted the Swiss National to be extradited to Malaysia, even though there is no evidence that the country has any rights of jurisdiction in the case, which concerned an accusation of blackmail by PetroSaudi against their former Director and his acquisition of their company data.

Sources have told Sarawak Report that Thailand has refused to allow the unwarranted extradition request, which has been fiercely challenged by the Swiss authorities who believe their national has been targeted for being a whistleblower.  Having now served 18 months he was eligible to return home to Switzerland.

Najib wants Justo in jail

There are questions as to what, if any, new information Xavier Justo can bring to further investigations into 1MDB, which are now at an advanced stage in several countries which have been engaged in a cross border collaboration to trace up to $7 billion which are calculated to have gone missing from the fund.

Justo has already provided the data relating to the original PetroSaudi deal from which $1.83 billion was siphoned from the fund and the US has obtained extensive details of the dollar transactions that were involved. Numerous banks are now also collaborating with investigators from at least 7 countries and several accounts are frozen.
Furthermore, two senior executives from the Abu Dhabi fund Aabar, who were implicated in thefts are now also in jail in Abu Dhabi and believed to be cooperating with their authorities who have lodged a major case to reclaim $6.5 billion from 1MDB.

Nevertheless, recorded conversations and text messages from PetroSaudi Director Patrick Mahony, which were sent last year, make quite clear that he believed that Najib was fearful at the thought of Justo ever being let free. “A prime minister of a country is in deep shit” Mahony told Laura Justo in French in October last year.  He made clear that Najib was controlling Justo’s imprisonment and that if he wanted to be let free he needed to demonstrate that he would not speak against him after his release.

Mahony also made a number of demands that Justo and his wife should make statements to the press that assisted Najib and accused critics of 1MDB of dishonesty, in particular Sarawak Report.

After 18 months of separation from her husband, during which time Justo has seen his son just once, Laura says all she wants is to have he safely home in Switzerland. She believes he is no use and no threat to anyone in Malaysia.

“I cannot take much more of this. I am so scared”

She told Sarawak Report after the two separate warnings about the plans to kill him reached her early on Thursday evening.

I still maintain we must change the present system of choosing a leader.
Priority should be to limit the term of Premiership to just TWO TERMS.  The chosen leader cannot hold other post.  This must be added into the Constitution.

We have seen how corrupted the leaders have become and how cruel one can get to hold onto the post.

Jho Low's Price For Selling Malaysia Out To China Via The East Coast Rail Project

Sarawak Report exposed Najib’s secret bail out plan for 1MDB, using the East Coast Rail Project, last July.
Internal documents acquired by this site provided a breakdown of the entire cost of the project negotiated with the Chinese state company CCCC, which has already been banned by the World Bank because of its record of corrupt practice (see base of article).
The information showed that the construction company, together with the Malaysian Finance Ministry (Najib) had deceitfully agreed to inflate the cost of the entire project by over 100%, in order to hide the repayment of US$5.63 billion of 1MDB debt.

The deal included a $315 million purchase price for two companies controlled by Jho Low – his apparent price for negotiating the crooked deal with Beijing.

Despite denials the project went ahead

At the time Najib and his ministers angrily denounced and denied our story, calling it all a bag of lies.
According to the leaked schedule, which formed part of these documents, the Cabinet was due to review the project on 25th July and (of course) agree to it on 27th July.  However, the Minister of Public Works, Fadillah Yusof, denied on the 26th July that the matter had ever been discussed.
Yet, only a few weeks later in October, the project with CCCC was announced just as we had reported with only a few cosmetic changes to the overall figures we had pubished (lopping RM5 bn off the projected costs). There had been no public tendering exercise for mega-construction, which experts unsurprisingly have pointed out is indeed double the cost of equivalent structures.
What’s more, just as the document we released in July had stated, it was confirmed that the entire project will be financed by a ‘soft loan’ from China at 2% interest with an intial 7 year ‘holiday’ from repayments, thereby getting Najib off the hook over 1MDB’s missing billions entirely and leaving all the problems of repayment to his sucessors.

The deal has apparently been guaranteed by unspecified ‘land assets’ promised to the Chinese and cemented by pledges of a new strategic balance towards the nearby super-power, which is already starting to assert its naval presence in the ultra-sensitive Malacca straits and also in Malaysian waters in the South China Sea, where China has been eying fishing and oil reserves and doubtless also the lands and wealth of North East Borneo (East Malaysia).
In short, Najib has sold out his country to China in his attempt to cover up the massive thefts from 1MDB, billions of which ended up in his own accounts or were frittered away in the gargantuan spendthrift extravagances and investments by Jho Low.

Power-grab by China

The benefits to China are spelt out clearly in the draft document (see entire copy of the document below):
“Direct award on extremely favourable terms by GOM on an accelerated basis”
“Malaysia’s adoption of Chinese rail technology into Malaysia’s mega infrastructure projects”
“Malaysia’s acceptance and expansion of China’s One Belt, One Road strategy”
In other words, there would be no tiresome tendering or ‘bureaucratic hold-ups’ caused by such matters as due diligence, since this was to be a classic Najib/Jho Low lightening deal, no questions asked.  Also, crucially, the project will now tie Malaysia into China’s sphere of influence in terms of key transportation and trade routes.
Furthermore, Najib has been happy to hand total control over the manning of the strategic project to the Chinese state contractor, meaning that China will be in charge of all procurement and jobs will go to Chinese rather than Malaysian construction workers, even though it will be the Malaysian taxpayer who will be footing the bill:
“10 year tax break fro GST and Income Tax”
“GOM will assist by taking responsibility for land acquisition and borne (sic) the cost”
“Allowing CCCC to select partners, suppliers and subcontractors”
“Assist in seeking approval for CCCC to utilize bank guarantee rather than cash retention sum”

Big fat kickback to Jho Low?

It is widely known that Jho Low was spending much of his time in China in the run up to the conclusion of this awful deal for Malaysia.  The now notorious deal maker is tied to the hip with the Prime Minister over 1MDB.
So, little surprise that the corrupted secret schedule (“for internal use only”) details what is plainly another handsome pay-off for the Penang born billionaire, who has already purloined billions of dollars from the Malaysian taxpayer.
Written into the deal are not only precise dates and figures for the upcoming payments due on the 1MDB power purchase bonds (controversially shouldered by Abu Dhabi’s IPIC in 2015, which the sovereign fund is now contesting), but also multi-million buy outs of  connected shares in two companies inextricably linked both to Jho Low and to the scandal of the payments into Najib’s own bank acounts, Putrajaya Perdana Berhad and Loh & Loh for a total cost of $315 million.

The history of both these companies is closely linked to the unfolding scandal of 1MDB.  They were originally purchased by Sarawak Chief Minister Taib Mahmud’s company UBG Group on the advice of Jho Low after Taib made a killing selling off RHB Bank to the government controlled Employee Provident Fund.

Jho Low then took a 50% stake in UBG in 2008.
Later, in 2010, Jho Low used a bogus subsidiary of the 1MDB ‘joint venture partner’ PetroSaudi to buy out the entire group, using US$260 siphoned out of the development fund to leverage the deal.
As Sarawak Report has demonstrated the bogus PetroSaudi subsidiary named Jarvace was in fact controlled by Jho Low, who then later transferred both Loh & Loh and PPB back to UBG Group.
In 2012 both companies were sold on the same day to separate entitities: PPB to Cendana Destini Sdn Bhd and Loh & Loh to Selesa Produktif Sdn Bhd for a total of RM500 million.
However, both evidently remain under the control of Jho Low, whose close associate and former Alternate Director on the Board of UBG Group, Vern Tact, still sits on the board of both companies.

Another Director in both companies is Mohd Faizul Bin Ibrahim, again demonstrating the continuing ties between the companies and the remaining link to Jho Low.
Equally indicative has been the string of favourable government contracts which these companies have benefitted from:
“For over a decade PPB has been involved in a multitude of landmark residential and infrastructure projects throughout Malaysia. Another tell-tale sign of favour in high places was the decision by the Pilgramage fund Tabung Haji to invest in a hefty 30% share in PPB, thereby injecting a fat sum of public money once again into Jho Lows pockets.

The thread of collusion continues with the revelation that it was none other than the company PPB that the Malaysian Anti-Corruption Commission’s investigation identified as a vital intermediary in the siphoning of funds from 1MDB’s subsidiary SRC International into the Prime Minister’s accounts at AmBank in 2014/15.  This was according to the very papers waved before press cameras by the Attorney General appointed by Najib to “clear” him last January.

Close ups of those documents showed that one of the trails employed by the head of SRC International, Nik Faisal Arif Kamil (another associate of Jho Low) to transfer 70 million of ringgit into the Prime Minister’s accounts used payments funnelled through PPB.

Much of the money was used to fund Najib’s credit card expenses and also construction works on his home, the purchase of millions of dollars worth of diamonds and luxury goods and also anti-aging treatment.

So, perhaps little surprise that Najib and Jho Low have colluded to off-load these two tainted companies as part of the deal to pay off 1MDB’s debts via the East Coast Rail Project.
In the process Jho Low appears to have generated a handsome profit by selling the companies two times over using money borrowed by the taxpayer – three time over, if you count the Tabung Haji deal.
Notably, only 70% of PBB is being off-loaded, implying that Tabung Haji is still lumbered with its 30%, whilst 10% of Loh & Loh also remains, presumably in the hands of its original shareholders, with 90% sold on.
The Chairman of Loh & Loh, Y.A.M. Tengku Dato’ Rahimah Binti Almarhum Sultan Mahmud, also has ties with 1MDB: she is the younger sister of the Sultan of Terangganu and used to be on the Board of 1MDB’s predecessor the Teregganu Investment Authority, which was set up on the advice of a friend of the royal family, Jho Low.
Low brought her onto the Loh & Loh Board when he bought into UBG in 2008 through the company Majestic Masterpiece and she says she then bought half the multi-million dollar company in 2012 together with Board Member Rashidi bin Che Omar, who sits on numerous government related companies (including Tadmax Resources, which was bailed out thanks to a land purchase by 1MDB, which few could understand the reason for):

Apart from the sale of the two tainted Jho Low companies, the CCCC East Coast Rail Project secret schedule lays out in clear detail with full amounts and dates exactly how the Chinese company had contracted to pay off 1MDB’s debts with specified dates and amounts as repayments became due.
The first of these repayments were planned for October of this year, after the contract was due to be signed and announced.  Najib’s ministers declared that Sarawak Report was lying when it published this information in July.  Nevertheless, in December Second Finance Minister Johari duly announced that at last, in the final quarter of the year, 1MDB had indeed managed to take over the settlement of its own debts from IPIC – without offering any other explaination as to how this had been done.

The repayments are clearly and correctly listed in the leaked document, right up till the final due date in 2022, totalling the agreed overspend of RM29.85 billion.  Thrown in are the sale of the Jho Low companies, netting him over US$300 million and also a fat “consultancy fee” to be paid through a company of CCCC’s choice of RM79 million, to a yet unknown entitity.
The entire project reeks of corruption and treachery against the people of Malaysia.
And whilst BN ministers have attempted to accuse Sarawak Report of lying with the release of this material they have signally failed to provide their own figures or any transparent break-down of the grossly inflated costs of what has now been recognised as one of the most expensive rail projects ever commissioned anywhere in the world – all behind closed doors and managed by the Prime Minister/ Finance Minister of Malaysia, Najib Razak and his partner Jho Low.

Why are Malay divorce rate higher than the norm?

I would like to share what I know.

Malay couples do not know nor do they understand the meaning of love and understanding. 
Malays do not like long courtship.  They want everything fast and they do not want long term commitments.

To the male, marriage is for sex and someone to look after him.  Some feel to have babies is a sign of maturity.  The male has fantasy that marriage is about having sex daily, someone to cook for him, someone to see to his needs.  Someone to share his problems and take care of him financially.

To the female.  Wow the pleasure of sex if the men are capable.  But in most cases, the men just screw for his own pleasure and cares nothing for the women.  So the wonder of sex is putting in the penis and turning soft within seconds. That is why out of 10 women, none are satisfied.  But then the women will say it is fated to have a man who does not know how to satisfy a woman.  So the woman slowly turned off having sex.  Unless you are Shahrizat or Rosmah or Ng Yen Yen, then toyboys are not that easily available for the unfortunate ones. Today there are rubber women for men to pleasure themselves but not rubber men for women, so many are going for the poor cucumber or having sex with their dogs.

The marriages in most cases for the Malay women would be, they have to keep house, pay for all the household bills and if there are kids, then the burden is heavier as men will complain they are tired from working whole day to help out.

I know of many Malay men who comes home from work, turn on the TV and rest.  They demand for hot cooked food, they refuse to wash the dishes, mop or sweep the floor, fold the clothes or iron or change the baby diapers. They complain of stress and over work.  They will tell their wives to massage them and demand for sex even though the wife is tired from all the chores.

Most Malay men look for capable women.  Those with Master or PhD, earning better than them.  Women who are docile and does not complain much especially the ones they feel they can control. To the men these are the ingredients for marriage.  There is no thought of love, understanding and caring.

I have never come across a single Malay couple who holds hands during their marriage nor do they proclaim love for each other except Rosmah who was seen holding Najib’s hand because of his fear for the present Agong. After marriage one of the spouse will treat the other like servant.  Their first demand is a one sided game of satisfaction in bed, next - drink must be serve even though he or she has two hands and legs. Slowly the bills and chores are done by one person.  There is no more talking instead commands are given. I know of someone like that in a 45 years of marriage.


Every week I help out at a centre for married couples and it never fail to enlighten me that couples have fail to understand each other, lack of sharing, lack of communication, lack of satisfaction in love making, lack of caring (most people forget the importance of birthday and other celebrations) and most important there is no such thing as saying I LOVE YOU.

Can you afford to untie the knot?

AFTER six long years, Pial Khalida Abdullah finally got her wish last May: the judge granted her a divorce.
Her sweet victory, however, lasted only for 14 days – her supposed-to-be-ex-husband filed an appeal against the judge’s decision, preventing the Syariah Court from releasing her divorce letter and closing her case.
“I am financially drained and emotionally exhausted. Yet again to fight for the appeal, I need to hire a lawyer and fork out thousands of ringgit,” Pial lamented on Facebook.
Worse, she added, in Syariah Court, you have to open a separate file for every different petition, such as custody for children, child maintenance and others, each one costing a separate fee.
“Today, I have four cases: appeal for the divorce, custody of my kids, child maintenance, and visitation rights. All cases (are) treated separately and each costing a separate amount of money,” she shared her frustration.
For many Muslim women contesting for divorce, this is the fear: that their case will drag on for years due to the bureaucracy of the Syariah Court, which is said to favour men.
And with the escalating cost of living forecasted to continue this year, lengthy divorce proceedings and endless delays in court are something that not many can afford to endure.
So much so that many are choosing to forgo legal counsel, like Sarina (not her real name).
“At first I wanted to get a lawyer from the Government’s Legal Aid Department but after reading up on it I feel that I don’t really need to get a lawyer to file for a divorce,” she says.
However, the forms are not free and cost from RM3 to RM25. And as she later discovered, the process is not as simple as she had expected.
“I still ended up going up and down the courts, and that cost money – with transport and time off work,” says the entrepreneur.
For a manager who only wants to be known as Noor, getting a good lawyer at whatever cost is a must to ensure she stop her husband – who took another wife without her consent – from getting custody of her two sons.
“He is making it difficult for me by not turning up in court, though, and the postponements are causing me money,” grumbles Noor, who says she has racked up more than RM20,000 in legal fees, and her case seems nowhere near closure.
Syariah lawyer Muhammad Nur Hafiz Roslan thinks there is a prevailing misconception that legal fees will burn a hole in one’s pocket when filing for divorce.
“Many are scared to go see a lawyer because of this misleading belief. What many don’t realise, for example, is that not all lawyers charge fees for the initial consultation, which is important for you to plan your course of action when getting a divorce.
“If after consulting the lawyer you feel that you can do it on your own, you always can. We have had many such cases at our firm and we didn’t charge them for that consultation.”
He points out that many cases are delayed because the parties involved did not follow court procedures and lacked understanding of the court’s requirements.
Nur Hafiz, who is also the managing director of Nur Hafiz & Associates, says lawyers’ consultation fees depend on the “seniority” of the lawyer.
Like in any field, you have the high-end players, he quips, “If you go to the ‘Datuk-Datuk’ lawyers, of course you would expect to pay more.”
But, as he stresses, it is important to go to a qualified lawyer who has a strong knowledge of not only Malaysian Islamic family law but also a deep understanding of Islamic jurisprudence.
At the end of the day, he says, it is all about a person’s priority: “Many people won’t even bat an eyelid over how much they have to fork out for a smartphone, but when it comes to legal advice for their and their children’s survival and future, they are not willing to spend a sen.”
Another Syariah lawyer, Saadiah Din, agrees that getting a qualified legal counsel is important.
“Many cases get stuck because the pleading was badly or wrongly drafted by the parties themselves or the lawyers or the defendant filed other applications that delayed the proceedings,” she says.
Other reasons why cases take a longer time to be resolved include parties changing lawyers, incomplete court documents, or one of the parties is not Malaysian or residing out of jurisdiction and gives all sorts of excuses to postpone the matter.
And naturally, she adds, if the matters are heavily contested, they will take a longer time to be heard by the court.
Another (cheaper) option for couples to resolve their marital issues, she opines, is getting marriage counselling.
“Instead of filing for the divorce, she or he may report to the marriage division at the religious office nearest to their house. The counselling unit will arrange for single and double counselling sessions to enable the parties to give their marriage a second chance.”
Still, Saadiah strongly believes there is room for improvement to expedite court proceedings and the religious bodies have set up committees to review the written laws/enactments/regulations/arahan amalan (practice directions) to enable a better administration of justice in the Syariah Court.
While non-Muslim divorces rarely get dragged out as long as some Muslim divorce cases do, some cases can take time to get resolved – contested divorces can take up to three years.
The cost for a joint petition – where both parties agree to divorce – is between RM3,000 and RM6,000 and usually takes three to six months. Contested petitions, however, vary in costs from one firm to another, depending on the level of conflict and complexity of issues, says lawyer Datuk Andy Low Hann Yong whose firm has handled many contentious divorce cases.
A quick check on the fees around the Klang Valley for these challenging cases shows they can range from RM25,000 to RM50,000. A highly contentious divorce can even incur RM75,000 in legal fees.
Those looking for “savings” in their divorce case can try mediation, which is faster and can cost less, from RM5,000 to RM 15,000, to be resolved.
And like in the Syariah law fraternity, legal fees for civil family lawyers at the higher end of the market are reportedly steeper – it can cost up to RM10,000 for uncontested divorce petitions.
While a Malaysian Bar Council source says there are no plans to hike legal fees, many feel that legal costs are generally rising. Says Low, this is mainly due to the hike in court filing fees a few years ago.
Still, for divorce cases in Syariah Courts, the cost cannot be capped until the law addresses the issue of absent and noncompliant husbands who do not turn up in court or ignore court orders to pay maintenance to their children and ex-wife.
Former Chief Syariah Judge Datuk Ismail Yahya, who was also a former mufti in Terengganu, believes many divorce cases can be expedited if they are converted to fasakh, that is, for the court or the judge to declare the dissolution.
“I’ve handled a divorce case that took as long as 12 years to be resolved because the husband never turned up for the hearings. But this was because he was a petty thief and drug addict, so he kept going in and out of jail.
“So what her legal team should have done was to convert the case to a fasakh case so that the court would have the authority to dissolve the marriage,” he says.
As he sees it, many have the misconception that fasakh is a difficult process.
“What they don’t realise is that for fasakh, the husband’s appearance in court – the main reason why many divorce cases drag on – is not needed. The wives just need strong evidence.”
Denying that he is blaming Syariah lawyers for the delays in divorce cases in court, Ismail says many do not advise their clients to change to fasakh because we practise an adversarial system here where the court does not take an active role in the case.
“In an inquisitorial system, like that practised in France and Saudi Arabia, the court will take a more active role and the judge can steer the case to what is best and advise the petitioner likewise.”
Saadiah, however, disagrees.

“Although we are practising the adversarial system, the Syariah Courts usually welcome evidence that will assist the judge in making his/her decision,” she says.
Norhayati Kaprawi, a former programme director at Sisters In Islam, believes strongly that women can avoid protracted cases if they get more information on their rights as a wife in Islam and the Islamic Family Law, as well as the Syariah Court system and its procedures.
As accessibility to the information is lacking, she says, it has prompted her to team up with Ismail to publish a handbook on Malaysian Islamic Family Law.
“I find that there are not many books that are available in the market that can help to explain very clearly how women can access justice in the Syariah court system, about the court procedures, what are the wives’ rights in Islam and in the Islamic Family Law.
“There are still many women who don’t even know what the first step they should take is when they want to get a divorce. They don’t even know the basic things, such as whether they need to go the Jabatan Agama or Syariah Court. They don’t even know what forms to fill,” she says, citing the example of an abused or neglected wife.
“Many do not know they can actually apply under fasakh,” she notes.
“So now, they can get Datuk Ismail, who knows the law in depth and has vast experience in dealing with divorce cases, to explain very clearly how women can get their rights in Syariah Court.”

Putrajaya's Airbus Corporate Jet 319 bearing the registration number 9M-NAA can no longer be tracked on flightaware.com. 
The website said the data was not available for tracking as "per request from the owner/operator". 
The request to remove public access to the data came shortly after Malaysiakini highlighted 9M-NAA's trip across Australia, which coincided with Prime Minister Najib Abdul Razak's family vacation Down Under. 
The last time the tracking data was available was on Tuesday, which showed 9M-NAA touching down at Sultan Abdul Aziz Shah airport in Subang Jaya at 10.17pm after taking off from Perth International Airport at 4.56pm local time. 
The data was removed from the site yesterday. When contacted, FlightAware said it offered blocking services on condition that the request is accompanied with a copy of the aircraft's registration. 
It added that the flight tracking service also allowed private tracking for owners of the aircraft. "This would allow for only authorised users on your account to view the flight activity. 
It would still be blocked to the general public," it said. Prior to this, data from flightradar24.com, another tracking site, was also removed. Apart from 9M-NAA, a Airbus Corporate Jet 320 with registration number 9M-NAB, which the prime minister had previously used, has also been removed from the tracking sites. 
A trip of two weeks On Dec 31, Malaysiakini highlighted Prime Minister Najib Abdul Razak's son Norashman posting photos on Instagram from Gold Coast and Perth on dates which were consistent with where the 9M-NAA was. 
The plane took off from the Sultan Abdul Aziz Shah airport in Subang Jaya at 12.07am on Dec 22 and landed in Gold Coast, Australia, at 10.06am the same day. 
However, the stop was brief as the aircraft took off from Gold Coast at 11.47am and landed in Brisbane at 12.09pm. The plane remained in Brisbane for four days. 
On Dec 26, the Malaysian government jet took off from Brisbane at 9.11am and landed in Gold Coast at 9.35am. 
Again, the stopover at Gold Coast was brief, lasting only two hours and 47 minutes. The plane then departed Gold Coast at 12.22pm and arrived at the Perth International Airport at 2.47pm. It returned to Malaysia on Jan 3.

Is hijab in the Qur’an?

Many assume that the hijab is in the Qur’an – or, more specifically, many assume that what is thought of today as female Islamic dress is required by the Qur’an.
In this post I clarify what the Qur’an itself says on this disproportionately emotive subject.
The word ḥijāb occurs 7 times the Qur’an (at 7:46, 17:45, 19:17, 33:53, 38:32, 41:5, 42:51).

It denotes:
  • A barrier between believers and deniers in the hereafter (7:46)
  • A barrier placed between the messenger and those who do not believe in the hereafter when he recites the Recitation or qur’ān (17:45)
  • A barrier or partition which Mary mother of Jesus placed between herself and her people (19:17)
  • A barrier or partition in the house of the prophet so that protocol might be observed between common believers and wives of the prophet (33:53)
  • A barrier or partition behind which the sun disappears at the end of the day (38:32)
  • A barrier or partition which prevents those who hear the message from understanding it (41:5)
  • A barrier from behind which God gives instruction to a mortal (42:51)
We plainly see that in none of those instances in which the Qur’an uses the term ḥijāb does it denote clothing of any sort – female or otherwise.
So, clearly, the idea that ḥijāb denotes a particular style of female headwear was devised outside the Qur’anic revelation.
The question, then, is whether that which we call ḥijāb today has any Qur’anic basis, and what the Qur’anic position is on the subject of female dress.
There are only two verses which treat of dress for women: 24:31 and 33:59.

The verses are self-explanatory with the only remaining question being what we mean by adornment as per 24:31.The case is clear what is meant from the end of the verse: adornment is that which is revealed by striking the feet (or walking suggestively). If we are to be reasonable, there is no case in which a woman could walk in such a way as to reveal her face or hair were it covered.
However, she could walk in such a way as to make her bottom and breasts visible to others – as we all know.
The key takeaways as found in the Qur’an regarding women’s dress then, are:
  • That a believing woman should restrain some part of her vision (i.e. not stare) – a directive which is the same for men
  • That a believing woman should guard her modesty (i.e. be chaste and modest) – a directive which is the same for men
  • That a believing woman should cover her bosom and not walk in such a way as to reveal such parts of her body which suggestive walking can reveal
  • That a believing woman is not to walk in the way outlined above (i.e. provocatively or suggestively)
  • That a believing woman is to draw down (i.e. lengthen) some part of her garments (i.e. wear longer rather than shorter clothes)
  • The point of longer clothes is that believing women might be recognised as such and not hindered
These imperatives are for believing women. The context is perfectly clear: there will be other women who do not dress in such a manner (otherwise there would be no-one from whom to distinguish believing women).
Nowhere is there any hint that believers are to coerce non-believers to dress likewise.
This summarises the entire Qur’anic dress code for women.
Since this is a central issue for many people what follows are my own thoughts, and you are welcome to disagree with them. I begin by summarising my key points in the following way:
Q: Is it true that the Qur’an requires a head-covering for all believing women?
A: No, it is not.
Q: Does the Qur’an require believing women to dress modestly?
A: Yes, it does.
Q: Do societies exist where a head-covering is a requirement of modesty?
A: Yes, there do.
Q: Does traditional ‘Islamic’ dress (i.e. long dress and headscarf) encompass the Qur’anic requirement for believing women?
A: Yes, it does.
Q: Is the traditional ‘Islamic’ dress the same thing as the Qur’anic requirement?
A: No, it is not.
Now, while I know the claim that traditional ‘Islamic’ dress is a Qur’anic imperative to be false, I must add the following point: women are told to dress so that they will be recognised as believers and not hindered. A headscarf and the other modesty requirements found in traditional ‘Islamic’ dress together meet this criterion for historical reasons (i.e. such women are by dint of custom known to be women of faith).
However, traditional Jewish and Christian (Orthodox) women’s dress meets these requirements also.
Distinct from these observations, it is my opinion that women who choose to dress modestly are providing a great service to themselves, their families and their societies.
The problem in today’s media-driven society, of course, is that the association with faith which the headscarf once had has given way to other associations: those of intellectual and cultural backwardness and unthinking adherence to violent ideologies.
It seems to me that many women are put off wearing some form of headscarf due to fear that they will be incorrectly associated with ideologies which they don’t support. On the other hand, some choose to wear it because they wish to feel part of a club.
Women I have spoken to who wear or have worn a headscarf speak both of feeling protected by it from the general degradation around them, and of feeling misunderstood and wrongly judged on its basis.
I personally think the so-called ḥijāb can be extremely beautiful and refined and truly feminine. It makes almost every woman who wears one a queen and shows that she respects herself and her femininity as well the society in which she lives. But that does not mean that the headscarf – for me at least – is any sort of arbiter of faith. I hold it to be a crime before God to ascribe to the Qur’an imperatives which the Qur’an simply does not contain, and it is not one I wish to be guilty of.
There is no Qur’anic directive to wear what we call the ḥijāb. If women choose to see the wearing of what they call the ḥijāb as a requirement of their faith, they should be clear in declaring the source of that requirement to be other than the Qur’an.

KUALA LUMPUR, Jan 9 — The Selangor government is offering scholarships for selected residents to pursue doctorate courses at renowned universities abroad even as Putrajaya slashes its education budget amid an austerity drive.
The scholarship, under the state government’s special “Selangor Brain Bank” programme, was announced by Mentri Besar Datuk Seri Mohamed Azmin Ali on his Facebook page today.
The special programme requires applicants to have their research proposals accepted by their respective universities of choice, and also for the proposal of their choice to “contribute to Selangor’s development.”
The main 11 fields of research as listed under the state’s “Smart Selangor” programme ranges from governance and housing to education.
Another 10 related fields of research are also accepted — including culture, manufacturing and Islamic affairs.
The universities chosen by the applicants have to be listed as among the top 50 universities in respective fields of study — going by the Ranking by Subject in the 2015 Times Higher Education or the QS World University Ranking.
Applicants are also required not to be more than 40 years old at the time of starting their respective courses.
The scholarship is open for both civil servants in Selangor and the public — but both must have served either in the Selangor civil service or in private firms for five years at the very least.
Civil servants are required to to submit applications via respective department heads while private workers are required to obtain release letters from their employers.
Selected applicants will be called in for an interview.
The closing date for applications is on January 31.
The scholarship funds come from the Selangor Consolidated Scholarship Fund Board, which had also financed other scholarship offers in the state before.
Last year, the fund, under the “Selangorku” special programme, sponsored 110 Selangor students from poor backgrounds to pursue higher education at Universiti Selangor (Unisel) and Selangor Islamic International University College (KUIS).
Applications for the Selangorku programme are also open until January 16.
The application forms for both scholarship offers are available on the fund’s website.
Last year, Putrajaya slashed scholarships offered to students under the Public Services Department during the 2016 budget revisions.
For the 2017 Budget, Prime Minister Datuk Seri Najib Razak announced RM4.3 billion in scholarships under the Higher Education Ministry, but the Ministry’s overall budget was reduced to RM9.5 billion, a 29 per cent cut.
